The City has completed review of the Unified Development Ordinance (UDO). The UDO was approved by the Board of Commissioners on July 25, 2011 and will amend and/or replace several chapters in the current City of Havelock Code of Ordinances.

The City of Havelock received a federal Community Economic Adjustment Planning Assistance grant from the Office of Economic Adjustment in 2008 to update and improve the City’s current development and environmental protection regulations through the development of a Unified Development Ordinance (UDO). The need for the UDO was based on several implementation tasks listed in both the 2001 Eastern Carolina Joint Land Use Study and the 2001 Air Installation Compatible Use Zone (AICUZ) Study Update for Marine Corps Air Station (MCAS) Cherry Point, which identified numerous deficiencies in the City’s current codes, which together prevent the City from adequately protecting the facility from incompatible land use encroachment.

The City of Havelock contracted with The Wooten Company in 2008 to prepare the UDO, which would consolidate, update and remove all duplications and inconsistencies in the City’s development and permitted use regulations and standards. Overall, the Internal Review Draft of the UDO attached to this Summary provides the City the legal tools it currently lacks to adequately manage growth, facilitate high quality and sustainable development, and enforce modern development regulations to facilitate orderly development within the vicinity of Marine Corps Air Station (MCAS) Cherry Point, ensure land use compatibility within noise zones and accident potential zones (APZs), mitigate noise impacts from aircraft overflights and overall contribute to the safe operation of MCAS Cherry Point.
